don't you set that on the VPN client? Either to user the gateway of remote network or not?

I would like to know this for L2TP over IPsec for remote dial-in actually.
Remote dial-in does not seem to support a plain IPsec sa with routing, and the L2TP tunnel does not let me specify using anything other than the remote gateway.

Isn't that just normal behaviour...i.e. VPN traffic for the remote LAN goes via the tunnel... normal Internet traffic goes direcly to the internet, not into the VPN (unless you deliberately set it to).

its depends on the system and what updates you have installed

For Example Win7 doesn't or at least didn't set the remote network at the default gateway whereas Win 8 does.
